Cheers Charlie but I just can't see the point in threatening them with litigation if we can't see it through, which we wouldn't be able to, plus it is Toyota HQ who are pulling the strings not the dealer we got it from. Last time I spoke to the service manager at the dealership and the manager at the repair body shop they said everything was going to be done as far as they was aware so obviously summat has happened in between times? So what is it about buying rom garages on hills Paul the cost of a small claims procedure is less then £100. It’s a system set up to sort out uncomplicated legal mostly comsumer arguments such us your situation. Trust me on this one. That dealership will fold the moment the pre litigation paper hits thier doorstep. They just will !! The problem with buying from garages rages on a hill is they see you coming. Its an old joke. Your contract is with the Dealer Not Toyota GB. Of course your dealer would like Toyota GB to pay the bill but if they don’t thevDealer MUST bring the vehicle up to a retail merchantable quality. Simple

Simple Charlie's advice is right on the money, Paul. If that dealership had any sense of customer service they would have apologised for messing you around, "blamed" Toyota GB for an admin cock-up or whatever and booked your car back in for a proper repair. Charlie's right, once they see that you aren't going to be messed with, they'll sort it out. As for Toyota GB, I reckon they stay in business through good luck not ability; they are bloody useless.

OK Charlie and Jim I will go down this route if they don't get it sorted, but I don't see how I can get the dealer to do it if they have gotta get it passed by TGB, apparently TGB had had four quotes from the repair shop until TGB were happy with one which was just a rub down and repaint on the effected areas, all I know is that the first one the repair shop wanted to replace the tailgate with a new one but was declined as it was only surface rust??

Paul, contractually, your relationship is with the dealer. TGB only got involved because of T's own dealer arrangements. The dealer hass the obligation, not TGB.

OK Jim I phoned em again today and it looks like the service manager is getting the ball rolling again as a separate job now but just waiting on a response from TGB.

Some good news. Local Toyota service manager phoned and said that the other rust repair has now been authorised by Toyota HQ so just gotta arrange a date for it :TU:
