Bit confused. Did you actually put in wrong fuel and tell the dealer such or did they tell you that the car had been misfuelled? I was sure that I had put the right fuel but Dealer gave judgement this in theirr health check report that it was misfueled. But now I have all the proof that it was definitely fueled with right fuel i.e. Diesel

For that reason we’ve been trying to answer your questions based on that information. So as I said above and assuming you’d been recovered to that dealer why on earth would they start draining the tank. In your position on that day I would have immediately done two things.. I’d have reached directly for the receipt I’d been given only a short while before. Then I’d have put my nose to the filler cap of the car. If petrol had been put in the smell would have been strong and unmistakable. Petrol is lighter than diesel so will float. Do a Google search which will confirm this. So the smell of the vapour off that petrol would be very strong. With respect why on earth would a technician start draining a tank unless he or she had been pointed in that direction ? Sorry pal it just doesn’t add up .

Charlie..thanks.. Yes I said at the begeining of the thread that I had misfueled...that is ONLY because thats what Toyota Delaers told me as diagnisis..Yes I requested Asda Fuel Station to provide me CCTV and a receipt which took them all this time!! I have now received the receipt clearly indicating and proving that i DID indeed put the correct fuel i.e. Diesel..as to your question why would the technician empty the tank..well your guess is as good as mine! To charge with £700 just to do that! Adds up now? The second opinion garage also said there was absolutely NO smell of petrol in the system..i.e fuel injectors etc. However one injectors was found faulty and it has been replaced. Anyway now the car starts but throws clouds of black smoke...The DPF according to someone is gone/melted...but even after removing it completely the car still throws black smoke with No power to drive. I have been told to bite the bullet and scrap the car now! I appreciate your kind help all along..thank you.

OK, we understand that you have reasonable proof that the fuel you bought at Asda was priced as diesel. We have no idea as to what was actually dispensed so there remains a possibility, however small, that it was contaminated fuel or even petrol - just as a possibility. How much did you put in? I.e. did you fill from an almost empty tank or merely top-up from half full?
What exactly happened and exactly what did you tell the recovery driver / receiving dealer? To Charlie's point, it seems rather 'odd' that the dealer should diagnose misfuelling ahead of anything else unless someone or something pointed them in that direction.
All of which is, to some extent, academic since you are - or rather your car is - where it is now and a non-runner. Remote diagnosis is rather difficult. Do you have confidence in the garage that now has the car?

Thank you Philip... Asda has CCTV and Detailed Receipt..Show Showing which Pump I used..which Nozzle I used ..which was Diesel and Price chargfed was also for Diesel.. I was in reserve so I filled up the whole tank. After about amile and a half car coughed juddered..threw a pbig puff of black smoke and stopped. Engine sign came up on dash..and also said check 4x4 system..It would not start after that. Hired a recovery driver to drop the car to Hills Of Woodfor Toyota and told them exactly what happend on phone. NO one told the dealer that it was misfueled as NO ONE knew what was wrong..! (by the way they claim to record all conversations...so easy to prove what I said) They promised me full Diagnosis for £125 ...took them almost 2 weeks to tell me it was misfueld ...gave me hope that at £700 they will empty the tank and hopefully everything should be fine..Promised me a new Fuel Filter and £30 worth of Diesel. After that they came back saying ALL 4 fuell injectors have gone and need to replace them at extra £2K...Still no assurance that that would be end of it..so I collected car (with 4 injectors lying on the car floor in front of passenger seat)..Took it to a injector specialist who found 1 injector faulty..replaced it..car starts now but throws lot of black smoke..Garage says DPF is melted and even after removing the DPF car still throws heavy black smoke and NO power to drive ..so I have been advised to Bite The Bullet and scrap the car! The mechanic confirmed that there was NO smell of Petrol in the entire fuel line to the engine which was odd!! Thank you all of you for taking the trouble to help me. Merry Christmas.

Drew my friend IF you had presented that exact sequence of events in your first post it would have saved soooo much confusion and us second guessing as to what went wrong and how in our humble opinions to rectify .. So your recovery driver arrives at the dealers and informs them what has occurred. We then have to suppose the dealers technician jumped the gun and thought it was just another miss fueling of another car and set about draining ... My next question is important. Did you speak to anyone from that Toyota dealer yourself BEFORE they drained the tank ? If the answer is NO then you must put everything in writing and address it to the Dealer Principle. You must keep a copy of all and any letters Emails etc etc. If you are sure you didn't indicate to either the recovery driver or the Dealers staff that miss fueling had occurred then its either the dealers staff or the recovery driver who've jumped the gun, How you can prove it is a tough one but im not sure the onus is on you to prove anything. Your the cars owners who may or may have not have any knowledge of cars. With respect just one thing troubles me. Despite what your saying now and trust me im not doubting you you did start this thread by informing us you'd miss fueled your car... From a litigation point of view its a tough one. But what I would do and if your entirely sure you never indicated miss fueling is send that letter to the dealer principle .. If they refuse to negotiate some sensible sort of agreement spend £65 and initiate a small claims procedure. They will not ignore that. No business big or small wants to actually go before a district judge. Not only can it prove costly but reputations are won or lost. But think vary carefully. Unless your 100% sure of the above take it like a man and suck it up. We all make mistakes and the conclusion 99% of us would make after the car broke down is I've miss fueled.
